Booking agency terms
What we do, what we don't do, and what applies if something gets in the way. Last updated: September 2026.
1. What these terms cover
They apply to every agency contract between you and Rent a Todo, owner David Leicht, Im Oberdorf 22, 75181 Pforzheim, Germany, in the version sent to you with the offer.
They do not apply to the rental itself. The rental company's own terms apply there. Your own terms apply only if we agree to them in text form.
2. We arrange rentals, we don't rent out
We have no fleet of our own. We find you a rental company in the Canaries, obtain an offer and make a binding reservation for you. That is our service.
The rental contract is concluded exclusively between you and the rental company, on the island and under its terms. Vehicle, handover, insurance, excess, security deposit, damage and return are governed solely by what is agreed there.
Prices, minimum ages, licence classes and security deposits are passed on as the rental companies state them to us. They become binding with the offer.
3. How the contract is formed
Your enquiry is free and non-binding. It commits neither you nor us.
We ask one or more rental companies and email you an offer: vehicle, company, dates, total price, down payment, balance, security deposit. The offer is valid until the date stated in it.
The agency contract is formed when you accept the offer on the booking page. We then send you the payment details. Once the down payment arrives we make a binding reservation and send you the booking confirmation with the company's name, address and phone number.
4. Price, down payment, when it is due
The down payment is 20% of the rental price stated in the offer. It is our agency fee, due when you accept the offer, payable to us by bank transfer or PayPal.
On the island you pay only the rest. The total stays the same as booking with the rental company directly.
You pay the remaining 80% and the security deposit to the rental company at pick-up, under its terms. As a small business under § 19 of the German VAT Act we do not charge VAT.
5. Cancellation and refunds
As long as we have not yet made a binding reservation, you can cancel free of charge at any time and get the down payment back in full. A short email is enough.
From the booking confirmation onwards our service has been performed. The down payment is then no longer refunded. We charge nothing further.
You get the down payment back in full if we cannot obtain an offer, the rental company cancels, fails to provide the vehicle or the vehicle differs materially from the offer. The money comes back within 14 days, by the same means you paid.
If you want to change the dates, tell us: we will try once, free of charge, with the rental company. That is not a promise. Its own cancellation terms apply to the remaining 80% and the security deposit.

6. What we need from you
Your details on age, licence and dates have to be correct, because the whole referral rests on them. Anyone at the counter with the wrong licence gets no vehicle and usually nothing back.
You need a valid licence of the right class, the minimum age the rental company requires and usually a credit card in your own name for the security deposit. Your offer states exactly what applies. Bring the original licence plus an ID card or passport.
7. Liability
We are liable for arranging the rental properly: for passing on correctly what the rental company promised, and for making a binding reservation. The vehicle, defects, accidents, staff conduct and how things go on the island are the rental company's responsibility, not ours.
For intent and gross negligence, and for injury to life, body or health, we are liable without limitation.
For ordinary negligence we are liable only for breaching a duty whose fulfilment makes the contract possible in the first place and on which you may rely — limited to the foreseeable damage typical of this kind of contract. Liability is otherwise excluded.
8. Passing on your data
To arrange the rental we pass your name, dates, vehicle request and, if you gave them, phone number and accommodation to the rental company. Details are in the privacy policy.
9. Law, language, dispute resolution
German law applies. If you are a consumer resident in another country, the mandatory consumer protection rules of your country of residence remain unaffected.
The contract language is the language the offer was sent in. In case of discrepancies the German version prevails.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 of the German VSBG).
